1. Agreement to these terms

These Terms of Service (the “Terms”) govern your access to and use of Lumyhired — the website at www.lumyhired.com and the related tools and services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

The Service is intended for individual job seekers aged 18 or over. It is not for use by anyone under 18.

We may update these Terms from time to time. When we do, we change the “Last updated” date above and, where the change is material and affects an existing subscription, we give reasonable advance notice. Your continued use after a change takes effect means you accept the revised Terms.

2. Who you are contracting with

The Service is operated by a sole trader (entrepreneur individuel) registered in France. As French law requires, the operator’s full legal identity, registration number and address are published on the mentions légales page. For any question about these Terms or the Service, use our contact page.

3. What the Service is — and is not

Lumyhired is a software tool for job seekers. It tailors your CV to a job description, audits it against applicant-tracking-system (ATS) parsing rules, searches public job boards, drafts cover letters and outreach messages, and tracks your applications.

Lumyhired is not an employer, a recruitment or staffing agency, or a party to any hiring decision or employment contract. We do not place you in a job and we do not guarantee interviews, offers, a job, or any particular outcome. You are responsible for your own applications and for your dealings with employers.

4. Your account

You must give accurate registration information and keep it current. You are responsible for activity under your account and for keeping your credentials secure. Sign in is by email/password, Google sign-in, or a one-time magic link. We may suspend or close an account that breaches these Terms or applicable law.

5. Plans, prices and payment

Plans are billed weekly: Starter €5/week, Pro €8/week, Hunt €13/week. Each plan includes a set number of AI actions per rolling 7-day window (audits, adaptations, cover letters, job searches, and so on); the current allowances are shown on the pricing page.

Prices are in euros. TVA non applicable, art. 293 B du CGI (VAT is not charged — the operator is under the French VAT-exemption scheme for small businesses). Payment is processed by Stripe, Inc.; we do not store your card details. The amount due, the billing period and the automatic renewal are shown at checkout before you pay.

There is no free plan. A limited, account-free ATS extraction preview is available at /ats-preview; during the open beta, new accounts may receive a time-limited grant of a paid plan at no charge, which ends when the beta grant expires or is withdrawn.

6. Automatic renewal and cancellation

A subscription renews automatically at the end of each weekly period at the then-current price until you cancel. You can cancel at any time from your account’s billing page or via the Stripe customer portal. Cancellation stops future renewals and takes effect at the end of the current paid week; you keep access until then. Cancelling does not by itself refund a charge already taken.

7. Right of withdrawal (EU/French consumers)

As a consumer, you normally have 14 days to withdraw from a distance contract (art. L221-18 of the French Code de la consommation), without giving a reason. Because the Service is digital content/services supplied immediately, when you start using a paid feature you expressly ask for performance to begin during the withdrawal period and acknowledge that you lose the right of withdrawal once performance has fully begun (art. L221-28, 13°). This express request and acknowledgement is collected at checkout.

Separately and regardless of the above, we offer a 3-day money-back guarantee from your first payment: ask within three days of that payment and we refund it in full, no reason required. This is a commercial goodwill policy in addition to your statutory rights, not a replacement for them.

8. Refunds

Except for the money-back guarantee above, for a valid exercise of a statutory right, or where required by law, payments are non-refundable. Nothing in these Terms limits any non-waivable consumer right; if the law where you live gives you stronger cancellation or refund rights, those apply. We may correct genuine billing errors and refund or re-charge accordingly.

9. Your content

Your CV and everything you submit remain yours. You grant us only the limited licence needed to run the Service for you — to store, process and transmit that content to produce your audits, tailored CVs, letters and outreach, including sending it to the AI providers listed in our privacy policy. We do not sell your content and we do not use it to train AI models.

You are responsible for the accuracy of what you submit and for having the right to submit it. Do not upload another person’s CV or personal data without their permission.

10. AI-generated output

Audits, tailored CVs, cover letters and outreach messages are generated by language models and may contain errors or omissions. Review everything before you send it. You remain solely responsible for what you submit to an employer. We do not warrant that any output will pass a given ATS, match a role, or produce a response.

11. Acceptable use

You agree not to:

misrepresent your experience, identity or qualifications;
upload unlawful, infringing, or another person’s content without permission;
scrape, harvest, resell or redistribute the Service, its output, or data obtained through it;
use bots or automated means to access the Service or to submit applications in breach of a job board’s own terms;
attempt to break, overload, reverse-engineer or circumvent the security or usage limits of the Service.

12. Data about other people (recruiters, hiring managers, company officers)

To help you find the right person to contact about a job, the Service may show publicly available professional information about third parties — a name, public headline, profile URL and city drawn from public search results, and the names and roles of company officers listed in the French company register (RNE / data from recherche-entreprises.api.gouv.fr, which publishes SIREN/SIRET records). We process this under our legitimate interest (art. 6(1)(f) GDPR) in helping job seekers reach the right contact.

If you are one of those people and want your information removed, use lumyhired.com/people/remove or our contact page. We will suppress and delete it. You may also object to this processing at any time (art. 21 GDPR).

13. Deleting your data and closing your account

You can delete your account at any time from your account’s settings (billing page → “Delete my account”). Deletion is permanent and immediate: it cancels any active subscription and erases your profile, CVs, adaptations, job searches, saved jobs, applications and related data. There is no recovery window.

14. Third-party services and links

The Service relies on third-party processors (for hosting, database and auth, payments, AI generation, and job/company lookups) and may link to third-party job boards and websites. Those third parties are governed by their own terms and privacy policies; we are not responsible for their content or practices. The processors we use are listed in the privacy policy.

15. Intellectual property

The Service, its software, design and branding are owned by us or our licensors and are protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service for your own job search. You may not copy, resell, or exploit the Service or its content beyond that use.

16. Availability and changes

We aim to keep the Service available but cannot guarantee it is uninterrupted or error-free. We may change, suspend or discontinue parts of the Service, and perform maintenance, without notice. We are not liable for downtime, though this does not affect your statutory rights or any refund owed for a paid service we fail to provide.

17. Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind. We do not warrant that the Service will meet your requirements, produce any hiring outcome, or be free of errors. This does not exclude warranties that cannot lawfully be excluded, including your consumer guarantees under French law (garantie légale de conformité).

18. Limitation of liability

To the extent permitted by law, we are not liable for indirect or consequential loss, lost profits, or lost data, and our total liability for any claim is limited to the amount you paid us in the three months before the event giving rise to the claim. Nothing here limits liability that cannot lawfully be limited — including liability for death or personal injury caused by negligence, fraud, or your non-waivable consumer rights.

19. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you materially breach these Terms or applicable law. Terms that by their nature should survive termination (content licence, disclaimers, liability limits, governing law) continue to apply.

20. Governing law and dispute resolution

These Terms are governed by French law. As a consumer, you also keep the protection of the mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts with jurisdiction there.

Before going to court, you may contact us to resolve any complaint. If it is not resolved, you may refer the dispute free of charge to a consumer mediator (médiateur de la consommation), in accordance with art. L616-1 of the Code de la consommation: [MEDIATOR NAME AND WEBSITE — TO BE DESIGNATED]. You may also use the European Commission’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
